1. General provisions
1.1. These Terms of Use, hereinafter referred to as – Terms of use, determines the website www.women.lv, hereinafter – Women's store, procedures for use and purchase of goods.
1.2. SIA “WingsLogistic”, registration No. 40203192551, address: “Liepas iela A” – 3, Ogregals, Ogres county, LV-5041, hereinafter – WingsLogistic, provides content available to the Women store and provides services in accordance with the Terms of Use.
1.3. User is a legally capable natural or legal person who shops at the Women store or uses other Women store services. Minor natural persons between the ages of 14 and 18 use the Women store services only with the permission of a parent or guardian, except in cases where they have their own income.
1.4. If the User purchases goods offered by the Women store, the Terms of Use are considered a legally binding document that sets out the rights and obligations of the parties in relation to the purchase of goods, payment for them, as well as the conditions for the delivery and return of goods.
1.5. If the User wishes to purchase goods in the Women store, the User is obliged to familiarize himself with the Terms of Use before purchasing the goods and to confirm this familiarization before completing the transaction. Thus, if the User has purchased a product in the Women store, it is considered that the User has familiarized himself with the Terms of Use and agrees to them. At the same time, by agreeing to the Terms of Use, the User also confirms that he has the right to register and purchase goods on the Women store website in accordance with the Terms of Use.
1.6. If the User attempts to harm the operation, stability, security of the Women store in any way, or otherwise fails to comply with these Terms of Use, WingsLogistic has the right to cancel the User's registration or otherwise restrict the User's access to the Women store website.
1.7. WingsLogistic reserves the right to unilaterally amend and supplement the Terms of Use at any time. When the User makes a purchase in the Women store, the Terms of Use in the version valid at the time of ordering the goods are applied, therefore the User must familiarize himself with the Terms of Use each time he makes a purchase.
1.8. WingsLogistic reserves the right to change the price of the goods, or to set a special price for the goods. The goods are sold to the User at the prices valid at the time of placing the order for the goods.
2. Protection of personal data
2.1. You can shop at the Women store as a guest and as a registered User. To register at the Women store, the User must provide at least their first name, last name, email address, and enter a password. By registering on the Women website, it is considered that the User (natural person) has agreed to the processing of their personal data in accordance with the procedures specified in regulatory enactments and in accordance with the WingsLogistic Privacy Policy - to the extent that the User has provided personal data. To re-enter the Women store website in the specific User profile, the User must enter the registered email and password in the appropriate fields.
2.2. When making a purchase in the Women store, the User must enter their name, surname, delivery address, phone number and e-mail, as this data is necessary for WingsLogistic to conclude a purchase agreement with the User and to ensure communication with the User, as well as delivery of goods to the User.
2.3. The User is permanently fully responsible for the accuracy of the data specified in the registration form, as well as for the accuracy of the data provided when making a purchase in the Women store. If the User has specified inaccurate or incorrect data in the registration form or when making a purchase, or has not updated them on the Women store website in the event of changes to personal data, WingsLogistic is not responsible for the inaccuracy of the data and the consequences arising therefrom and is entitled to claim compensation for direct losses from the User. The User has the right at any time to correct, delete or supplement personal data in his/her Women store profile or to request that WingsLogistic correct, delete or supplement personal data in accordance with the customer's instructions in accordance with the Privacy Policy.
2.4. When registering in the Women store, the User is responsible for the security of his registration data and undertakes to store them and not to transfer them to third parties. If the registration data is used by a third party, he is considered a User. If the User loses the registration data, or the User suspects that his registration data may have been obtained by a third party, the User must immediately inform WingsLogistic about it using the means of communication, where the Women store contacts are indicated, which can be found at the very bottom of the website (Footer).
2.5. By agreeing to these Terms of Use and Privacy Policy, the User agrees that notifications necessary for providing order, payment and delivery information will be sent to the specified e-mail address.
2.6. WingsLogistic guarantees that the User's data will be used only for the purposes of purchasing goods and direct marketing.
2.7. WingsLogistic undertakes to ensure the confidentiality and protection of personal data provided by the User, and undertakes not to disclose the User's personal data to third parties, except for WingsLogistic partners who ensure the delivery of goods to the User or provide other services related to the execution of orders, as well as to state institutions in the cases specified in regulatory enactments and if there is a legal basis for this.
2.8. At the time of delivery of the goods, the recipient of the goods may be asked to present an identification document to verify the person's identity.
3. Conclusion of a purchase and sale agreement
3.1. The user can purchase goods on the Women Store website an unlimited number of times.
3.2. The contract for the purchase of goods between WingsLogistic and the User is considered to be concluded from the moment the User, having selected the goods(s), has created a shopping cart and clicked on “place order”. The User is obliged to pay for the goods in accordance with the procedure and within the deadlines provided for in the Terms of Use.
3.3. Purchase agreements are registered and stored in the Women store database.
3.4. WingsLogistic agrees to deliver the goods ordered and paid for by the User to the address specified in the User's order, based on the conditions set out in paragraph 5 of the Terms of Use.
3.5. If WingsLogistic fails to contact the User within 3 (three) business days of placing the order, the order is canceled, WingsLogistic refunds the User only for the product, but the delivery fee is not refunded.
3.6. In an emergency situation, when WingsLogistic cannot ensure the delivery of the product purchased on the Women Shop website due to unforeseen circumstances, WingsLogistic undertakes to offer a similar product. If the User does not agree, WingsLogistic shall refund the User the money paid for the unavailable product as soon as possible, but no later than within 30 (thirty) calendar days from the moment the User refuses the similar product.
4. Prices of goods and payment procedures
4.1. The prices of goods on the Women shop website are indicated euros, VAT is included in the price.
4.2. The User pays for the goods in the following ways:
4.2.1. using online banking "paysera" services (when ordering a product);
4.2.2. by bank transfer (when ordering a product);
4.2.3. by credit card (when ordering a product);
4.3. If there is an overpayment for the goods, WingsLogistic will refund it to the User by transfer to the bank account from which the User made the payment for the goods. If the overpayment occurred using another payment method, the User must submit a written application to WingsLogistic, indicating the bank account number to which WingsLogistic must transfer the overpaid amount to the User.
5. Delivery of goods
5.1. When choosing a delivery method, the user undertakes to provide an accurate delivery address.
5.2. The Goods may be delivered to the User by WingsLogistic or its authorized representative.
5.3. The user undertakes to accept the ordered goods from the courier.
5.4 If the User's order amount is more than 100.00 EUR (one hundred euros and 00 euros cents), then the delivery of goods to the User is free of charge. WingsLogistic reserves the right at any time, at its discretion, to change the minimum order amount, starting from which delivery is free of charge.
5.5. WingsLogistic will do everything possible to ensure that the ordered goods are delivered as soon as possible. The estimated delivery time within Latvia is 2-3 (two to three) business days after the purchase is completed.
5.6. If the User is not available at the delivery address specified by the User, WingsLogistic has the right to transfer the goods to the person who is informed of the order number at the time of receipt. deliveries address, and has reached the age of majority, but the User does not have the right to make any claims against WingsLogistic regarding the delivery of goods to an inappropriate person.
5.7. If the delivery of the goods to the User is not possible due to the User's fault or due to circumstances dependent on the User (the User has specified an incorrect address, the User is not available at the specified address, the specified address cannot be accessed, etc.), the goods are not sent again, but the order is canceled. In such a case, WingsLogistic refunds the User only for the goods, but the delivery fee is not refunded.
5.8. After receiving the goods, the User or his representative checks the conformity of the goods with the order and signs for the receipt of the goods in the manner and place specified by the supplier of the goods. By signing for the receipt of the goods, the User or his representative confirms that the goods have been handed over to him in good condition and in accordance with the goods purchase contract. In all cases when the courier delivers the goods to the User, the packaging of which is wrinkled, wet or otherwise damaged from the outside, the User must indicate (write a comment) in the confirmation of receipt of the shipment or write a separate act about such defects. The User must do this in the presence of the courier. WingsLogistic is not responsible for such defects of the goods that were obvious at the time of delivery, but were not indicated in the confirmation of the delivery of the goods. WingsLogistic attaches the accompanying document for the delivery of the goods to the shipment of the goods or sends it electronically to the e-mail specified by the User after receiving confirmation of the delivery of the goods to the User.
6. Product quality
6.1. The characteristics of all goods sold in the Women store are indicated in the product description for each product. WingsLogistic ensures that the main characteristics of the goods sold in the Women store (information about the manufacturer, model, color, volume, etc.) correspond to the actual characteristics of the goods and the terms of the contract. The criteria for the conformity of the goods with the terms of the contract are specified in the Consumer Rights Protection Law.
6.2. Goods purchased on the Women Shop website are subject to the warranty specified in the relevant legal acts.
6.3. If, after receiving the goods, the User (within the meaning of Section 6, a consumer within the meaning of the Consumer Rights Protection Law – a natural person who purchases a good for a purpose that is not related to his/her economic or professional activities) finds that the good does not comply with the terms of the contract, then in accordance with the procedure specified in the Consumer Rights Protection Law, the User is entitled to file a claim with WingsLogistic regarding the non-compliance of the goods with the terms of the contract within two years from the date of receipt of the goods. The User shall submit the claim to WingsLogistic within two months from the date of discovery of the non-compliance of the goods with the terms of the contract.
6.4. After the expiry of the period specified in clause 6.3, the User is entitled to file a claim for non-compliance of the product with the terms of the contract, taking into account the product's warranty period.
6.5. In the event of a product not complying with the terms of the Agreement, the User has the right to request that WingsLogistic perform one of the following actions:
1) eliminates the non-compliance of the goods with the terms of the contract;
2) exchange the goods for one that would ensure compliance with the terms of the contract;
3) reduce the price of the goods accordingly;
4) cancel the contract and refund the amount of money paid for the goods to the consumer.
6.6. First of all, the User has the right to ask WingsLogistic to eliminate the non-conformity of the goods with the terms of the contract free of charge or to exchange the goods for a product that complies with the terms of the contract free of charge, except in cases where this is impossible or disproportionate (disproportionate if it causes WingsLogistic costs that are not proportionate to another alternative remedy specified in clause 6.5, taking into account the value of the goods without non-conformity, the significance of the non-conformity and whether the use of the alternative remedy does not cause significant inconvenience to the consumer).
6.7. If it is not possible to eliminate the non-conformity of the goods with the terms of the contract or to exchange the goods for goods that comply with the terms of the contract free of charge, the User has the right to request that WingsLogistic accordingly reduce the price of the goods or cancel the contract and refund the amount of money paid for the goods. When reducing the price or canceling the contract and refunding the amount of money, WingsLogistic may take into account the wear and tear of the goods or the benefit that the User has gained from using the goods, and which the contracting parties have agreed on.
6.8. In the event of a minor non-conformity of the product with the terms of the contract (it does not significantly reduce the quality of the performance of the basic functions of the product or its use characteristics and can be eliminated without causing visually detectable changes in the external appearance of the product) and such that cannot significantly affect the User's ability to use the product, the User cannot request that WingsLogistic cancel the contract and refund the amount paid for the product.
6.9. The User may express objections and requests regarding the non-compliance of the product with the terms of the contract to WingsLogistic both orally and in writing by sending a submission to WingsLogistic at the address Tirgoņu iela 8, Ogre, LV-5001. After evaluating the objections, WingsLogistic provides the User with a response.
7. Right of withdrawal and return of goods
7.1. If the User is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases a product for a purpose that is not related to his/her economic or professional activities), then in accordance with the procedure specified in Section 7, the User (consumer) may exercise the right of withdrawal without providing any justification. In accordance with the provisions of Cabinet of Ministers Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”, the consumer has the right to withdraw from the purchase contract within 30 calendar days from the moment of delivery of the product/products by submitting an application to WingsLogistic for the exercise of the right of withdrawal.
7.2. To exercise the right of withdrawal, the User must act in one of the following ways:
7.2.1. The User sends a notification electronically by e-mail to WingsLogistic's e-mail address: Info@women.lvIn the e-mail notification, the User indicates the return object (product name), order number and bank account number to which the User wishes to receive back the amount paid for the returned products. By sending a refusal to WingsLogistic e-mail. WingsLogistic shall notify the User of an application for exercising the right of withdrawal received in electronic form by e-mail immediately upon receipt;
7.2.2. The User fills out a withdrawal application through his/her profile on the Women store website. In order to exercise the right of withdrawal in this manner, the User first logs in to his/her user profile on the Women store website, selects the specific order in which he/she wishes to return the purchased goods in full or in part, and notes which goods and in what quantity the User wishes to return the goods to WingsLogistic. After specifying the name and quantity of the goods to be returned, the User must necessarily indicate the bank account number to which the User wishes to receive the amount paid for the returned goods back, as well as the User must indicate the method in which the User will return the goods to WingsLogistic (deliver the goods to the Wingslogistic office himself/herself, hand them over to a courier or place them in a parcel machine). The User may optionally indicate the reason for returning the goods. After entering this data, the User confirms the return application and returns the goods to WingsLogistic in the manner chosen by the User immediately, but no later than 30 days from the date of sending the withdrawal application. Once WingsLogistic has received the User's returned goods, WingsLogistic will send the User a confirmation of receipt of the goods.
7.3. The User shall be deemed to have observed the withdrawal period (30 days) if the User sends a notification of the exercise of the right of withdrawal to WingsLogistic in one of the ways specified in clause 7.2 of the Terms of Use before the expiration of the withdrawal period. In the event of disputes, the User is obliged to prove the fact and the period of exercise of the right of withdrawal.
7.4. In accordance with the procedure specified in clause 7.2.1 of the Terms of Use, after sending the information on the exercise of the right of withdrawal, the User shall return the goods to WingsLogistic by post, ensuring delivery of the goods to the following address: Tirgoņu iela 8, Ogre, LV-5001, without undue delay, but no later than within 30 days, or shall deliver the goods to the address specified by WingsLogistic within the said period. This period shall be deemed to have been met if the User returns the goods before the expiry of the 30-day period. The User is obliged to keep proof of the date of return of the goods.
7.5. If the User has used Omniva, Venipack, Posta courier or parcel machine services to receive the goods, the User has the right to send the goods back to WingsLogistic in both ways mentioned in clause 7.2 of the Terms of Use.
7.6. WingsLogistic shall, without undue delay, but not later than 14 days from the date of receipt of the User's application for the exercise of the right of withdrawal, refund the User the amount of money paid by him, including the delivery costs paid for the delivery of the goods. WingsLogistic shall transfer the refunded amount to the bank account specified by the User when exercising the right of withdrawal.
7.7. If the User, at the time of ordering the goods, had clearly expressed a desire to receive the goods using a delivery method other than the cheapest standard delivery method offered by WingsLogistic, WingsLogistic is not obliged to reimburse the User for additional delivery costs.
7.8. WingsLogistic reserves the right to withhold the refund of the amount paid for the purchase of goods to the User until WingsLogistic has received the returned goods from the User or has received confirmation from the User that the User has sent the goods back to WingsLogistic, depending on which action was taken earlier.
7.9. The direct costs of returning the product are borne by the User. If the product cannot be returned by post due to its characteristics, the consumer bears all costs associated with returning the product.
7.10. The User may exercise the right of withdrawal subject to the following conditions:
7.10.1. the returned product(s) must be in the original packaging and the User has not opened the packaging of the product;
7.10.2. the product must not be damaged;
7.10.3. the product has not been used, has not lost its commercial appearance (labels, safety films, etc. are preserved) (this does not apply to a product that was already damaged during delivery, for which the User has indicated objections when confirming receipt of the product);
7.10.4. The returned item must be in the same condition as it was upon receipt.
7.11. WingsLogistic has the right to refuse to accept the return of the product if the deadlines for returning the product were not met.
7.12. The User is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal. The User is responsible for any decrease in the value of the product if the product has been used in a manner that is incompatible with the principle of good faith, including use for a purpose other than to determine the properties or operation of the product. The products must be undamaged, have not lost the appearance of the product (labels not removed and not damaged, protective films not torn, etc.) and unused. The product must be returned in its original packaging, in the same configuration as it was received, and the purchase document and other accessories that were attached to it at the time of receipt must be returned. If the product is not fully assembled, damaged, untidy or not properly packaged, WingsLogistic has the right not to accept the product, as well as not to refund the User the money paid for the product.
8. Information exchange
8.1. WingsLogistic communicates with the User via e-mail, postal address or telephone number. The User may use any means of communication, where the Women store contacts are listed, which can be found at the very bottom of the website (Footer).
9. Responsibility
9.1. WingsLogistic is exempt from any liability in all cases where losses arise due to the User acting contrary to the rules of use of the Women store specified in the Terms of Use.
9.2. In the event of losses, the guilty party shall compensate the other party for direct losses.
9.3. The Women store is not responsible for any non-essential characteristics of the goods shown in the Women store images (actual size, shape or shade nuances, etc.) that do not correspond to the actual characteristics of the goods due to the screen parameters of the device used by the User, lighting or any other similar external conditions.
9.4. WingsLogistic is not liable for any delay in the performance of obligations or their non-performance, or any other type of non-performance, caused by circumstances and obstacles beyond WingsLogistic's reasonable control, including but not limited to strikes, government orders, war or a state of national emergency, terrorist threats or acts of terrorism, environmental or climatic anomalies, non-performance by third parties, disruptions in the internet connection, as well as computer equipment and software failures. In the event of such force majeure circumstances, WingsLogistic will try to eliminate the delays as soon as possible.
10. Other provisions
10.1. The relationship between the User and WingsLogistic is governed by the Terms of Use, as well as the laws of the Republic of Latvia.
10.2. If the order is made out to a natural person and the place of receipt is on the spot, to receive the order, it is sufficient to provide only the order ID number. In this case, the order can be received by you or a third party who knows the order ID number.
10.3. The order can also be shipped to EU countries, Scandinavia and 3 countries. When trying to purchase the product(s) it is not possible to deliver to your selected country, in which case you must contact our manager separately by e-mail info@women.lv so that the Women store can resolve this issue without delay.
10.4. In case of any questions or disputes, the User shall contact WingsLogistic customer service by telephone or e-mail. All disputes shall be resolved by the parties through negotiations, if possible. A User who is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases a product for a purpose that is not related to his/her economic or professional activities) has the opportunity to exercise and protect his/her legal rights as a consumer in accordance with the procedure specified in the Consumer Rights Protection Law and related regulatory enactments. If an agreement is not reached, the dispute shall be referred to court for consideration in accordance with the procedure specified in the legal acts of the Republic of Latvia.
10.5. In case you are unable to receive the product within the specified time, please notify our operators by calling +371 20038780 and we will agree with you on a change in delivery time.
Instructions on refusal
Right of withdrawal
If the Customer is a consumer within the meaning of the Consumer Rights Protection Law (a natural person who purchases goods(s) for a purpose that is not related to their business activities), the Customer may exercise the right of withdrawal. In accordance with the provisions of the Cabinet of Ministers of the Republic of Latvia Regulation No. 255 “Regulations on Distance Contracts”, the consumer has the right to return the goods purchased from the Women store to the property of SIA “WingsLogistic” within 30 (thirty) calendar days.
The period for exercising the right of withdrawal will expire after 30 (thirty) calendar days from the day on which the Customer acquires or a third party other than the carrier and indicated by the Customer acquires possession of the goods.
The Customer informs WingsLogistic about the return by notifying it in writing (info@women.lv) indicating the return object and order number. When returning the product(s), the Customer can use the sample return form or print it by requesting it from our manager via e-mail. info@women.lv, necessarily indicating the bank account number.
Consequences of refusal
If the Customer withdraws from this contract, WingsLogistic will refund all payments received from the Customer, including delivery costs. The refund will be made using the same means of payment that the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise. In any case, no fees will be charged to the Customer in connection with such refund. WingsLogistic may withhold the refund until the product(s) have been received back or until the Customer has provided proof that the product(s) have been sent back, whichever is the earlier.
The Customer shall send the goods to WingsLogistic's address: Tirgoņu iela 8, Ogre, LV-5001 without undue delay and in any event not later than 30 (thirty) calendar days from the date on which the Customer notified WingsLogistic of his decision to withdraw from this contract. The deadline shall be met if the Customer sends back the goods(s) before the expiry of the 30 (thirty) calendar day period.
The return of goods is subject to the following conditions:
– the returned item(s) must be in the original packaging;
– the goods must not be damaged;
– the goods have not been used, have not lost their commercial appearance (labels, safety films, etc. are preserved), (this does not apply to products that were already damaged during delivery);
– the returned item(s) must be in the same condition as when received;
– The customer must cover the direct return costs.
The customer is only liable for any decrease in the value of the goods if the goods were used for purposes other than to determine the type, properties and function of the goods.
